{"id":581,"date":"2016-01-26T13:11:23","date_gmt":"2016-01-26T13:11:23","guid":{"rendered":"http:\/\/pcaid-online.co.uk\/lexadeen\/?p=581"},"modified":"2020-05-02T16:04:02","modified_gmt":"2020-05-02T15:04:02","slug":"581-2","status":"publish","type":"post","link":"https:\/\/pcaid-online.co.uk\/lexadeen\/581-2\/","title":{"rendered":"Claimant found unfairly dismissed and awarded losses"},"content":{"rendered":"<p style=\"text-align: justify;\">The EAT (Langstaff P) has summarised the main principles in decisions on mitigation of loss in Cooper Contracting Ltd v Lindsey.<\/p>\n<p style=\"text-align: justify;\">The claimant Carpenter was found unfairly dismissed and awarded losses on the basis he was entitled to have commenced true self-employment post dismissal but there were better paid employed opportunities &#8220;out there&#8221;.<\/p>\n<p style=\"text-align: justify;\">The respondent&#8217;s grounds of appeal argued inadequate reasoning by the employment tribunal, stating the claimant had not reasonably mitigated his loss between dismissal and the hearing.<\/p>\n<p style=\"text-align: justify;\">Dismissing the appeal the EAT summarised the legal approach to mitigation:-<\/p>\n<ul>\n<li style=\"text-align: justify;\">The burden of proof is on the wrongdoer &#8211; not the claimant &#8211; so, without the former submitting mitigation evidence, the employment tribunal has no obligation to make a finding;<\/li>\n<li style=\"text-align: justify;\">the claimant must be shown to have acted &#8216;unreasonably&#8217;, not necessarily &#8216;not reasonably&#8217;;<\/li>\n<li style=\"text-align: justify;\">determination of unreasonableness is a question of fact, taking account of the claimant&#8217;s views and wishes, though assessment is objective.<\/li>\n<li style=\"text-align: justify;\">the employment tribunal should not put claimants on trial as if losses were their fault;<\/li>\n<li style=\"text-align: justify;\">the employment tribunal&#8217;s approach is: &#8220;It is for the wrongdoer to show that the claimant acted unreasonably in failing to mitigate&#8221;\u009d;<\/li>\n<li style=\"text-align: justify;\">failure to take better paid jobs do not necessarily satisfy the test.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The EAT (Langstaff P) has summarised the main principles in decisions on mitigation of loss in Cooper Contracting Ltd v Lindsey.
