{"id":884,"date":"2016-10-31T16:35:04","date_gmt":"2016-10-31T15:35:04","guid":{"rendered":"http:\/\/pcaid-online.co.uk\/lexadeen\/?p=884"},"modified":"2020-04-19T14:41:57","modified_gmt":"2020-04-19T13:41:57","slug":"calling-uber-drivers","status":"publish","type":"post","link":"https:\/\/pcaid-online.co.uk\/lexadeen\/calling-uber-drivers\/","title":{"rendered":"Calling all UBER drivers &#8230;"},"content":{"rendered":"<p style=\"text-align: justify;\">An employment tribunal has recently ruled that two drivers who provide services to gig economy stalwart Uber are &#8216;workers&#8217; as stipulated the Employment Rights Act 1996.<\/p>\n<p style=\"text-align: justify;\">This means they will be entitled to a limited number of employment rights (but not those accruing to &#8217;employees&#8217; &#8211; which this case was not about).<\/p>\n<p style=\"text-align: justify;\">Amongst other rights, as workers, they will be entitled to include:-<\/p>\n<ul>\n<li style=\"text-align: justify;\">5.6 weeks&#8217; paid annual leave each year<\/li>\n<li style=\"text-align: justify;\">a maximum 48 hour average working week, and rest breaks<\/li>\n<li style=\"text-align: justify;\">the national minimum wage (and the national living wage)<\/li>\n<li style=\"text-align: justify;\">protection of the whistleblowing legislation.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">As they are not employees, they will not be entitled to:-<\/p>\n<ul>\n<li style=\"text-align: justify;\">the ability to claim unfair dismissal<\/li>\n<li style=\"text-align: justify;\">the right to a statutory redundancy payment<\/li>\n<li style=\"text-align: justify;\">the benefit of the implied term of trust and confidence<\/li>\n<li style=\"text-align: justify;\">the protection of TUPE, if Uber sells its business<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Of course, it is almost certain that this tribunal decision will be appealed up and up, potentially to the Supreme Court. So, for now:-<\/p>\n<p style=\"text-align: justify;\">We suggest any Uber drivers should bring <a href=\"http:\/\/pcaid-online.co.uk\/lexadeen\/employment-law\/\">tribunal<\/a> claims on the assumption they are &#8216;workers&#8217;, and ask for the hearings to be stayed (put on hold) pending any appeals of last weeks decision.&nbsp; Although this decision is fact-specific, and based on Uber&#8217;s business model, it increases the chance of other &#8216;gig economy&#8217; companies facing claims that their &#8216;contractors&#8217; have worker status.<\/p>\n<p style=\"text-align: justify;\">Watch this space.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An employment tribunal has recently ruled that two drivers who provide services to gig economy stalwart Uber are &#8216;workers&#8217; as stipulated the Employment Rights Act 1996.
